PROGRAM COMMENCEMENT DATE : EARLY 2025

OBJECTIVE

  • Practical knowledge on how to interpret and apply an organisation’s Code of Conduct and Ethics,

  • To ensure your organisation’s HR Code of Conduct and Ethics address the most updated and current needs of business,

  • To ensure your employees perform their duties and responsibilities in line with ‘ethical’ best practices and standards, and

  • Practical strategies and steps to manage difficult situations involving Code of Conduct and Ethics breaches such as sexual harassment, borderline insubordination, conflict of interest, bribery and corruption as well as unauthorized audio recording of meetings and performance discussions.

Learning Outcomes

  • On successful completion of the program, you will be able to:

  • Guide your management team and employees on how to interpret ‘grey’ area situations involving Code of Conduct and Ethics breaches such as conflict of interest, borderline insubordination, sexual harassment, workplace bullying, bribery, corruption and other ‘integrity’ related issues,

  • Revise/update your organisation’s Code of Conduct to reflect the  current international best practice standards,

  • Effectively manage any Code of Conduct and Ethical breaches in line with the law and international best practices, and

  • Nurture a work environment that promotes an engaged and committed workforce who perform their duties with ‘integrity’.

Program Delivery & Duration

  • 10.5 hours of face-to-face/video conferencing training hours to be conducted over a period of 2 months.

  • Self-learning through a customised Code of Conduct and Ethics online learning management platform and ‘Employment Law’ application where participants will be required to complete in pace with the face to face/video conferencing sessions being held.

  • Two (2) months including a self-learning component and ten hours of face to face/video conferencing (over Zoom/Teams) facilitation.

Day One : 04th December 2024

10.30am to 1.00pm (Face-to-Face) – Monash Campus, Subang Jaya

Module One : Overview of The Law Involved In Code of Conduct and Ethics Breaches

  • Understanding Malaysia’s MACC (Amendment) Act

  • Areas under Malaysia’s Employment Act and Industrial Relations Act Which Intersects With An Organisation’s Code of Conduct and Ethics

  • Overview of key amendments under OSHA that impact an Organisation’s Code of Conduct and Ethics

  • Malaysia’s Personal Data Protection Act and how it affects confidentiality breaches in an organisation’s Code of Conduct and Ethics

  • Understanding Malaysia’s Code of Practices on the Prevention and Eradication of Sexual Harassment in the Workplace.

 

Module Two : Understanding ‘Integrity’

  • What does ‘integrity’ mean

  • Case studies where companies failed due to ‘integrity’ issues

  • The legal component to ‘integrity’

  • Understanding the ‘character’ component of integrity.

Day Two : 10th December 2024

2.30pm to 5.00pm (Online) – ZOOM/Teams

Module Three : Managing Malaysia’s Anti-Corruption and Bribery Law (MACC Amendment Act) (Part One)

  • The essence of Section 17A of the MACC Act

  • Penalties for non-compliance of the MACC Amendment Act and who can be held liable in an organisation

  • Differentiating bribery from corruption

  • Managing issues related to gifts, hospitality and entertainment.

 

Module Four : Managing Malaysia’s Anti-Corruption and Bribery Law (MACC Amendment Act) (Part Two)

  • Managing donations and sponsorships

  • Managing business relationships with third parties (agents, suppliers, JV partners) locally and overseas

  • Dealing with ‘conflict of interest’ related issues

  • Managing facilitation payment requests and off-set arrangements, and

  • How to deal with situations involving a breach of authority limits.

 

Day Three : 10th January 2025

2.30pm to 5.00pm (Online) – ZOOM/Teams

Module Five : Managing The Character Aspect of ‘Integrity’

  • How to behave with integrity in a world where profits often trumps doing ‘what is right’

  • Managing confidentiality breaches

  • Understanding the concept of ‘moral excellence’ and ethics

  • How to develop the right ‘moral compass’ (character profiling test) – identify your Top 5 Character/Behavioural Strengths

  • Ensuring you have the right moral compass when making decisions.

 

Module Six : Managing Sexual Harassment

  • Case study (managing a situation where a staff alleges she is uncomfortable with some remarks of a sexual nature being said about another employee ) – is this sexual harassment?

  • An organisation’s obligations under the law when faced with an allegation of sexual harassment

  • The two –step test for proving sexual harassment

  • How to apply the ‘balance of probabilities’ test when conducting a domestic inquiry in dealing with cases involving sexual harassment.

 

Day Four : 24th January 2025

2.30pm to 5.30pm (Online) – ZOOM/Teams

Module Seven : Managing Borderline Insubordination and Workplace Bullying/Harassment Allegations

  • Managing situations where an employee displays attitudinal/behavioural issues

  • Differentiating ‘borderline’ insubordination from ‘gross insubordination’

  • How to manage a complaint of workplace harassment.

Module Eight : Managing Safety and Health Breaches

  • Understanding an organisation’s responsibilities under the amended OSHA

  • Managing Health and Safety Issues That Impact Employees Mental Health.

 

Module Nine : Essay Discussion and Submission

  • Discussion on essay topics and submission requirements.

 

Participants here will be required to submit a paper of not less than 1200 words and work with their facilitator who will review and grade their report before the ‘Certificate of Successful Completion’ is issued by Monash University Malaysia. Participants will be required to submit their project paper by the deadline of January 31st, 2025.
