Program Details

  • This program is 2 months long and is delivered using a blended learning approach of video-conferencing and online access to a learning management system on industrial relations.

  • Four face-to-face/video-conferencing sessions will be held in addition to participants being required to complete the learning modules in the online IR learning management system.

  • Six core Employment Law/IR modules will be delivered. Upon completion of the modules, participants will be required to answer an essay question of not more than 12oo words and upon successful completion will be awarded the certification.

  • This program has been approved by the Human Resource Development Fund and fully claimable under the HRD Corp Claimable Courses (formerly known as SBL-Khas Scheme).

  • The cost of this program is only RM 2,950 per participant plus SST.

  • This program shall commence on May 03, 2024 and participants can look forward to obtaining their certification by the end of July/early August, 2024.

Objective :

To equip participants with:

  1. Knowledge on how to apply the law’s requirements of fairness and documentation when managing their employees and subordinates,

  2. Practical knowledge on how to ensure their organisation’s HR related processes and policies nurture an environment where employees are motivated to perform to their best potential,

  3. Practical understanding on how to comply with Malaysia’s amended Employment Act and Industrial Relations Act, and

  4. Skills on how to engage their subordinates when managing their day-to-day staff productivity, discipline and performance issues.

Methodology :

  • Self-learning through a customised Industrial Relations online learning management platform where participants will be required to complete in pace with the face to face/video conferencing sessions being held. The online self-learning system will provide assessments for better understanding of the material.

  • 10 hours of face to face/video conferencing

  •  A Certificate of Completion will be awarded only upon successful completion of the subjective assessment in the form of essay questions.

 

Course Content :

Employment Law and Industrial Relations Program

Introduction

This is an employment law and industrial relations program targeted primarily at the corporate market. The target audience for this programme will be HR practitioners and line managers in these companies and the programme will focus on equipping these target audiences with practical knowledge and skills on how best to manage their employees in line with the law’s requirements and industrial relations best practices. Industrial Relations competence is a key factor in being able to manage one’s subordinates correctly and without competence in this area, an organisation stands to lose out in terms of:

  1. Unhappy employees leaving the organisation due to morale and motivation issues,

  2. Productivity and performance, where employees are not managed to their best potential resulting in the organisation losing out in terms of business opportunities and profitability, and

  3.  Legal exposure where improperly managed employees or groups of employees initiate legal action against the organisation on grounds of unfair dismissal, constructive dismissal, non-compliance and forced resignations.

 

This program will use a primarily self-learning approach where participants will be given access to a learning portal. This will be supplemented with a five hour face-to-face (classroom and/or Zoom) learning session to ensure that the key learnings are accomplished.

 

Overview

This program aims to expose participants to key concepts and case studies surrounding industrial relations law and best practices. Upon successful completion of this program, the participant will be awarded a Certificate of Completion in Employee and Industrial Relations Program.

Program Learning Outcomes

On successful completion of the program participants will be able to:

  • Manage their day-to-day staff productivity, performance and attitudinal issues ranging from absences, tardiness, medical issues, misconducts to performance fairly and in line with industrial relations best practices,

  • Effectively document and communicate any performance/productivity/discipline issue faced by their employees in a manner that protects the organisation from any legal dispute,

  • Understand how to manage day to day staffing challenges in line with the requirements of Malaysia’s amended Employment Act and Industrial Relations Act, and

  • Nurture and engage their employees in helping them improve their work performance and contributions to the organisation.

 

Program Delivery

 

The program is delivered through:

  • Ten (10) Face to face/video conferencing training hours to be conducted over a period of two months.

  • Self-learning through a customised Industrial Relations online learning management platform where participants will be required to complete in pace with the face to face/video conferencing sessions being held.

 

Duration

Two (2) months including a self-learning component and ten hours of face to face (over Zoom) facilitation.

Module One : Overview of the Laws

  • Scope of Malaysia’s Employment Act 1955 (who is covered)

  •  Scope of Malaysia’s Industrial Relations Act 1967

  • The Sabah and Sarawak Labour Ordinance (Cap 67) and (Cap 76 respectively

  • Other regulations/laws

  1. Personal Data Protection Act 2010,

  2.  MACC Act 2009 (Amendment 2018),

  3. Code of Practice on the Prevention and Eradication of Sexual Harassment in the Workplace,

  4. Code of Conduct for Industrial Harmony, and

  5. (Termination and Lay-off Benefits) Regulations 1980.

 

Module Two : Starting the Employment Relationship Off Right and Managing the Probation Process

  • A manager’s role when a new employee joins the organisation,

  • Key aspects a manager needs to know about the job orientation process,

  • Understanding the law on probationary staff,

  • How to manage performance issues during the probation period,

  • Dealing with attitudinal issues arising during the probation process.

Module Three : Managing Discipline and Productivity Issues (Part One)

  • Managing absenteeism issues (Habitual and Section 15(2) EA 1955),

  • Managing tardiness, employees missing from the workplace during work hours and early-leavers,

  • Managing employees who habitually take medical leave.

 

Module Four : Managing Discipline and Productivity Issues (Part Two)

  • Discerning a medical leave from hospitalisation leave (where no hospitalisation is involved),

  • Managing emergency leave issues,

  • Managing prolonged illness issues,

  • How to manage mental health issues (depression, anxiety, and stress at the workplace).

  • Defining poor performance (differentiating inefficiency from negligence and insubordination),

  •  An organisation’s Performance Management System and Performance Improvement Plan Process,

  • Managing disputes over an employees’ performance appraisal rating score.

 

Module Six : Managing Poor Performance (Part Two)

  • Case study (managing a difficult staff) who is not performing,

  • How to effectively conduct a performance conversation with an under-performing employee,

  • The secret to having a successful performance conversation,

  • Using e-mails and other less traditional means of communicating performance expectations (do’s and don'ts).

Module Seven : Program Closing and Essay Assignment

•         Summary of Key Areas covered,

•         Briefing on essay assessment assignment.

 

Participants here will be required to submit a paper of not less than 1200 words and work with their facilitator who will review and grade their report before the ‘Certificate of Successful Completion’ is issued by Monash University Malaysia. Participants will be required to submit their project paper by the deadline of June 19th, 2024.

 

The certificate of successful completion will be awarded by July 25th, 2024.
